2. Nature of Service - Educational Simulation Only

ChartDojo is a trading simulation and educational platform. You expressly understand and agree that:

• All trades executed on ChartDojo use virtual currency only with no real monetary value
• The simulated account balance is for educational and entertainment purposes only
• No real financial transactions occur through our trading simulation
• Historical market data is used for practice purposes and may not reflect current market conditions
• Performance in our simulator does not guarantee similar results in real market trading
• We are not a broker, dealer, or registered investment advisor

3. Not Financial Advice

All content, including but not limited to AI-generated trade analysis, educational materials, scenario analysis, and feedback, is provided for educational and informational purposes only. This content should NOT be construed as:

• Financial or investment advice
• A recommendation to buy, sell, or hold any financial instrument
• An offer or solicitation to invest in any security or asset
• Tax or legal advice
• A guarantee of future trading performance

4. Risk Acknowledgment

By using ChartDojo, you acknowledge and agree that:

• Trading real financial markets involves substantial risk of loss, including the potential loss of your entire investment
• Past performance, whether on our simulator or in real markets, is not indicative of future results
• Skills developed in our simulator may not translate directly to real market success
• Real market conditions include factors not present in simulations, such as slippage, liquidity issues, emotional pressure, and market manipulation
• Leveraged trading (futures, forex, margin trading) carries especially high risk and can result in losses exceeding your initial investment
• You should never trade with money you cannot afford to lose

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• ChartDojo and its affiliates, officers, directors, employees, and agents shall NOT be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• We are NOT responsible for any trading losses, investment losses, or financial damages you may incur if you choose to trade real financial markets based on skills, strategies, or insights gained from our platform
• We make NO guarantees regarding the accuracy, completeness, or reliability of any information provided on our platform, including AI-generated analysis
• Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim

6. Indemnification

You agree to indemnify, defend, and hold harmless ChartDojo and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any trading decisions you make in real financial markets.

7. User Responsibilities

As a user of ChartDojo, you agree to:

• Provide accurate information during registration
• Maintain the security of your account credentials
• Use the Service only for lawful purposes
• Not attempt to manipulate, exploit, or abuse the platform
• Not share your account with others
• Be solely responsible for any decisions to trade real financial markets
• Seek independent professional advice before making real investment decisions

8. Subscription and Payments

If you purchase a subscription or credits:

• Payments are processed securely through Stripe
• Subscription fees are billed in advance on a recurring basis
• You may cancel your subscription at any time; access continues until the end of the billing period
• Refunds are handled on a case-by-case basis at our discretion
• AI credits are non-refundable once purchased
• We reserve the right to change pricing with reasonable notice

9. Account Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for any reason, including but not limited to: violation of these Terms, fraudulent activity, abuse of the platform, or any behavior we deem harmful to other users or our business. Upon termination, your right to use the Service will immediately cease.

10. Intellectual Property

All content, features, and functionality of ChartDojo, including but not limited to text, graphics, logos, software, and the overall design, are owned by ChartDojo and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

11. Third-Party Services

Our Service integrates with third-party services, including:

• Stripe - Payment processing
• Moonshot AI (Kimi) - AI-powered trade analysis
• Resend - Email delivery

Your use of these third-party services is subject to their respective terms of service and privacy policies.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
